I guess it depends on what your city's ethics policy states and how its layed out - is the code set out to GUIDE member's behavior establish behavioral REQUIREMENTS? It could be considered more of a "mission statement" than a hardlined policy.
Most of the time they're public, so if you're really curious you could find out and decide for yourself if it was a breach or not...
The fact she was being "indecent" with someone who isn't her husband is pretty skeevy, but is her business... To me - the her being "indecent" in PUBLIC and abusing time during working hours - is the violation, and would be grounds for her losing the commissioner position...
But this happens all the time, we had some dirty politics going on in my small town too with the town chairman, and nothing ever happened to him - he just had to pay back the money he EMBEZZLED FROM THE TOWN and was able to complete his term without any legal action against him or losing his position. Yeah...
