Just to protect yourself and your friend, purchase an inexpensive telephone recording device. They are the most efficient and the least expensive at Radio Shack (approx $16.00). The Radio Shack salesman will show you how to set it up. Believe me, it's very easy. I caught my soon to be ex-husband via a Radio Shack recording device ordering "phone sex and an escort service with our joint credit card"! I used this in court at our divorce hearing!

Although the wire taping/eavsedropping laws protect the abuser (because the persons being recorded are supposed to know ahead of time that they are being recorded or else they can threaten you for invading their privacy), In this case, Your friends life is worth more than the ridiculous "wire taping/eavsedropping laws!" Do not tell anybody that you are recording the phone calls! If he severely beats her up, you can phone the Texas police and file a second party complaint against your friend's abusive fiancee (play the recorded tapes of your friend being abused (screaming) and her fiancee threatening you to the police and the detective on call. This way, the police will definitely take you seriously and have a warrant for his arrest. Also, recommend that your friend phone a women's shelter so that she and her children can stay there for help! Shelters have on staff: many women's advocate counselors, social workers , women's attorneys. They will point your friend in the right direction! Call her local police department in Texas for the closest Women's shelter!

Go to a Free Legal workshop in your county. Ask about Sliding fee scales. You can file this restraining order against him on your own and it will cost you no more than $50.00 on a sliding fee scale. Please don't take anything your friend does personally. She is abused and confused. She knows that you want to help, she most likely wants to protect you from her fiancee by declining your offer to help her. Also, she is being mentally and physically abused by her fiancee. He is "brainwashing" her and now has a great deal of power over her. Don't take this personally. She will come to you when she is ready.

She's on point, though.

As far as the eavesdropping/wiretapping - recording laws go, I believe it varies from state to state, b/c in my state, only ONE person is required to know if the conversation is being recorded or not.... and that one person would be the one doing the recording! LOL!

SimplyMe,

I'm sorry about your girlfriend. Everything looked and sounded so promising; but she has that battered-woman's syndrome.
She has to keep proving her loyalty to this abuser; or else he'll beat her again (if he hasn't already beat her up for the police coming by). Don't give up hope on her. You're probably the only link she has to helping her break free of this man.

Great job you're doing.
